LATEST UPDATE: Reports published after the initial alarm over Neha Bora's whereabouts say that the AISA national president was subsequently released at the Narela Industrial Area Police Station. AISA has alleged that she was released without her mobile phone and bag. The circumstances surrounding her detention continue to require an official explanation.

Serious concern spread across social media on Sunday evening after reports emerged that AISA national president Neha Bora had been taken away during a protest in Delhi in a white vehicle said to be carrying police personnel.

Bora had been participating in a demonstration connected with demands for the resignation of Chief Election Commissioner Gyanesh Kumar. Videos, photographs and messages circulated online after the protest near Jantar Mantar, with AISA members and others seeking information about where she had been taken.

Initial accounts alleged that Bora was taken away at around 5 pm and that those present with her were not immediately informed of her destination. AISA representatives also alleged that the vehicle in which she was taken was not a conventional marked police vehicle and that no woman police officer was present inside it.

  • At what time was she brought to the Narela Industrial Area Police Station, and at what time was she released?
  • Were her mobile phone and bag taken into police possession and, if so, under what procedure?
  • If those belongings were retained after her release, when will they be returned and what record exists of their seizure?

Detention does not end the right to answers

The release of a detained protester does not by itself settle questions about how the detention was carried out. Public authorities exercise coercive power in the name of law. That power therefore carries a corresponding obligation to explain its legal basis and demonstrate that established procedure was followed.

Political disagreement does not remove procedural safeguards. Protesters, political activists and ordinary citizens remain entitled to the protection of law even when their speech is confrontational, inconvenient or deeply critical of those holding public office.

Nor should journalism convert unverified allegations into established facts. At this stage, several important details surrounding Bora's detention remain allegations made by AISA members, activists and people associated with the protest. Delhi Police should be given the opportunity to provide its official account.

The central question is no longer simply where Neha Bora is. She has reportedly been released. The question now is what happened between the moment she was taken away and the moment she was released, and whether every protection required by law was observed.
